How We Use Your Information

We use personal and usage data for the following purposes:

  • To enable chat / audio-video call functionality and manage your connections.
  • To improve your experience, analyse usage trends, address errors, ensure security and prevent abuse.
  • To communicate with you: send updates, notices regarding service changes, and respond to support enquiries.
  • For internal testing, analytics and service management.

We do not sell, rent or otherwise trade your personal information to advertising or unrelated third parties.

How we share your Information

We do not share your personal information publicly or make it visible to other users outside of private, user-initiated interactions such as audio or video calls. However, we may share your information in the following circumstances:

  • With other users you interact with

When you participate in an audio or video call, or chat with other users on Mingchat, limited profile information, such as your username, profile picture (if applicable), and call status, may be visible to the person you are speaking with. We do not share your phone number or any sensitive personal information unless you choose to disclose it during the interaction.

  • With your consent

We may share your information with third-party services or platforms only when you explicitly allow us to do so. For example, if you choose to send a call invitation via WhatsApp or SMS, those platforms' privacy policies will apply to the shared data.

  • With our service providers

We engage trusted third-party service providers to help operate and maintain Mingchat. These may include:

- Cloud storage and hosting services

- Call infrastructure providers

- Analytics and diagnostics partners

- Customer support tools

- Security and fraud detection services

- User engagement and notification platforms

- AI service providers, including providers of content moderation tools, chatbot infrastructure, and prompt generation systems

These providers only process your information on our behalf and under strict confidentiality and data protection obligations.

  • For legal and safety reasons

Your information is stored on servers located outside India, maintained by us and/or our authorised third-party service providers.

We engage third-party storage or hosting services to operate, support and maintain the App.

Security Measures

We use a combination of technical, physical, and administrative measures to help keep your personal information safe from loss, misuse, unauthorised access, disclosure, alteration, or destruction. These safeguards are designed based on the type of information we collect, and the risks involved.

However, your account security also depends on you. Please keep your login details, especially your password, confidential and do not share them with anyone.

While we take reasonable steps to protect your information, no system is completely secure. Information shared over the internet always carries some risk. We cannot guarantee that our safeguards will stop every unauthorized attempt to access or misuse your personal data.

If we ever identify a suspected breach of your personal information, we have procedures in place to respond. Where required by law, we will notify you and the relevant authorities as soon as possible.

Data Sharing and International Transfer

Your personal data is shared only with our trusted service providers for the purpose of operating, maintaining or supporting the MingChat App (e.g., hosting, data-backup or analytics).
We do not transfer your personal data to advertisers or unrelated third parties for marketing.
Since data is stored and processed outside India, international data transfers are subject to appropriate safeguards in accordance with applicable laws.

Retention and Deletion of Data

We retain your personal information and usage data for as long as your account is active.
If you choose to delete your account, we will permanently erase all your data (including username, mobile number, email, chat history and call history) from our systems, in line with our deletion policy, subject to any statutory requirement to retain for minimum period.

Some residual copies may remain in archival or backup form for a limited period as required by law or our internal policies, but will not be used for active service provision.

Children and Age Requirement

You must be at least 18 years old to register and use MingChat. We do not knowingly collect information from individuals under this age.

If we become aware that a person under 18 has registered, we will delete the account and associated data.

Rights of Users (including GDPR)

In accordance with applicable data protection laws, including the Digital Personal Data Protection Act, 2023 (India) and, where applicable, the General Data Protection Regulation (EU) 2016/679 (“GDPR”), users of MingChat (“Data Principals” under Indian law and “Data Subjects” under GDPR) are entitled to the following rights in relation to their personal data:

9.1. Right to Access Personal Data

You shall have the right to obtain confirmation as to whether MingChat is processing your personal data and, where such processing is taking place, to request access to the following information:

  • A summary of the personal data processed by MingChat;
  • The categories and nature of personal data being processed;
  • The specific purposes for which such personal data is processed;
  • The identities or categories of data processors, service providers, or third parties with whom such personal data has been shared;
  • Where applicable, information regarding cross-border transfers of personal data.

9.2. Right to Correction, Rectification, and Updating

You shall have the right to request correction, rectification, completion, or updating of any personal data that is inaccurate, incomplete, misleading, or outdated.

Upon receipt of a valid request, MingChat shall take reasonable steps to rectify or update the concerned personal data without undue delay and within timelines prescribed under applicable law.

9.3. Right to Erasure / Right to be Forgotten

You shall have the right to request erasure or deletion of your personal data where:

  • The personal data is no longer necessary for the purpose for which it was collected or processed;
  • You have withdrawn consent and no other lawful basis for processing exists;
  • Processing is unlawful or no longer compliant with applicable law.

Erasure shall be subject to statutory, contractual, or regulatory retention obligations, and limited data may be retained where required by law, court orders, or legitimate compliance purposes.

9.4. Right to Withdraw Consent

Where processing of personal data is based on consent, you shall have the right to withdraw such consent at any time.

Withdrawal of consent shall not affect the lawfulness of processing carried out prior to such withdrawal. Upon withdrawal, MingChat shall cease further processing of the relevant personal data unless such processing is required or permitted under applicable law.

You acknowledge that withdrawal of consent may result in restricted or discontinued access to certain features or services of the App.

9.5. Right to Object to or Restrict Processing

You shall have the right to object to, or request restriction of, processing of your personal data in circumstances where:

This right applies only to personal data processed by automated means and is subject to applicable technical and legal limitations.

9.7. Right to Grievance Redressal and Complaint

You shall have the right to lodge a grievance, complaint, or request in relation to the processing of your personal data, including concerns regarding misuse, unauthorised access, delay, or non-compliance with applicable data protection laws.

MingChat shall acknowledge and address such grievances in a timely manner and in accordance with statutory timelines.
